General Terms & Conditions of Sale

These terms and conditions of sale are concluded on the one hand:

  • By the Domaine de Nerleux, via the SCEA Neau, having its registered office in Bellevigne-les-Châteaux, registered with the Trade and Companies Register of Saumur under number 383 117 587, hereinafter referred to as "Domaine de Nerleux"

On the other hand :

  • Any individual or legal entity wishing to make a purchase via the website www.nerleux.fr (and its other URLs), hereinafter referred to as "the client"

These general terms and conditions of sale define the contractual provisions between Domaine de Nerleux and the customer, and the conditions applicable to any purchase made through the online store www.nerleux.fr. Purchasing a product or service through this website implies the customer's unreserved acceptance of these terms and conditions of sale.

Article 1: Prevention & Legal Information

Ordinance No. 59-107 of January 7, 1959, and Law No. 74-631 of July 5, 1974, prohibit the sale and offering of alcoholic beverages to minors and those considered as such. Therefore, by adding items to your cart, you acknowledge that you have the legal capacity to enter into this contract.
Alcohol abuse is dangerous for your health, consume with moderation.

Article 2: Online Store

The Domaine de Nerleux online store can be accessed at the following address: https://www.nerleux.fr
The items offered are those listed in the catalog published on the website www.nerleux.fr. These items are offered subject to availability. Each item is accompanied by a detailed description and its price.
In the event that the ordered item is unavailable, Domaine de Nerleux undertakes to inform the customer and offer them a credit or a refund up to the amount of the unavailable vintage.
The information contained in our materials (online shop, brochures, leaflets, etc.) is provided for informational purposes only and does not bind Domaine de Nerleux, which may modify it at any time.
The photographs on the product pages are for illustrative purposes only; the actual product may differ from the image shown. The information provided by the photographs is not binding on Domaine de Nerleux, which reserves the right to modify it at any time.

Domaine de Nerleux also reserves the right to correct any accidental material errors or omissions in these terms and conditions, as well as in any other contractual document.

Article 3: Prices

The prices displayed on the website www.nerleux.fr are inclusive of VAT and are in euros (€). The delivery cost is fixed at a flat rate based on the quantity ordered.
Domaine de Nerleux reserves the right to modify its prices at any time, it being understood that the price displayed on the website on the day of the order will be the only price applicable to the customer. Prices are valid only for Metropolitan France.

Article 4: Order

The order will only be fully validated once the following steps have been completed:

  • Select items and add to cart
  • Choice of delivery method
  • Validation of the contents of the basket
  • Identification or registration in order to provide the various requested details
  • Choice of payment method
  • Payment confirmation

The customer will then receive an order confirmation. Domaine de Nerleux retains ownership of the items until full payment for the order is received, meaning until Domaine de Nerleux has collected the order price. Furthermore, Domaine de Nerleux reserves the right to cancel or refuse any order placed by a customer with whom there is an existing dispute regarding payment for a previous order, or by a customer who is unable to complete the order.

Domaine de Nerleux undertakes to honor orders received on the website only within the limits of available stock.

Article 5: Payment terms

Payment for purchases can be made via one of the following methods, at the customer's convenience:

  • By credit card via Stripe
  • By wire transfer to the account below:
  • By check (shipment will be made after the check has cleared)

Article 6: Terms of delivery

All orders placed on the website www.nerleux.fr can only be delivered within Metropolitan France.

Deliveries are made from Monday to Friday. The delivery time is normally 3 or 4 days (depending on the region): this timeframe is given as an indication only.

Delivery of the ordered items is made to the address indicated at the time of the order, starting from the receipt of the order and/or its payment.

The customer has 30 days from the order confirmation date to report non-receipt of the items and request cancellation of the sale and a refund. After this period, no cancellation of the sale will be accepted.

Furthermore, the customer is required to check the condition of the delivered items upon receipt of the order. Any anomaly found (missing item, damaged package, etc.) must be reported to Domaine de Nerleux within 24 hours of receipt.

If a package is received damaged (one or more bottles), the recipient must refuse delivery. The carrier will inform Domaine de Nerleux. Domaine de Nerleux will resend an identical package to the recipient within 72 hours. Under no circumstances will the customer be entitled to a refund for the product or the delivery fee.

Article 7: Retraction

The Customer, a non-professional individual, has a 14-day withdrawal period from the date of receipt of their order to return the product to Domaine de Nerleux for exchange or refund without penalty. Return shipping costs are the responsibility of the Customer and must be made via home delivery. The Customer will be fully refunded as soon as possible and at the latest within 14 days of receiving the returned products.

Returned products must be unopened, undamaged, and in perfect condition. They must be returned in a condition suitable for resale. If returned products are damaged during transit, the customer must contact the delivery service provider. The customer must retain proof of shipment from the carrier. Without this proof, no exchange or refund can be issued in the event of a lost package.

Article 8: Responsibilities

Domaine de Nerleux cannot be held liable for failure to perform the contract, for stock shortages or product unavailability, for force majeure and, in particular, for total or partial strikes, floods, fires or other natural disasters and, in general, for all events that prevent the proper execution of the order.

Article 9: In case of dispute

These terms and conditions of sale are governed by French law. In the event of any difficulties in the application of these terms and conditions of sale, we invite you to contact us and seek an amicable solution by sending an email to contact@nerleux.fr. Failing that, the French courts will have jurisdiction.
